These Terms of Service apply to your use of the Eaton Community Pharmacy – online store and to purchases made through our website.

By using our website or placing an order with us, you agree to these Terms of Service.

These Terms are subject to your rights under the Australian Consumer Law (ACL) and other applicable Australian laws. Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded.

  • product information may change without notice where required by the manufacturer or supplier; and

  • some products may become unavailable or be subject to supply restrictions.

Where appropriate, we may contact you if there is a significant issue with a product you have ordered.

Nothing on our website is intended to replace professional medical advice from a doctor, pharmacist or other qualified healthcare professional.


4. Health and Medical Products

Information provided on our website about health products, medicines, vitamins, supplements, medical devices or other healthcare products is provided for general information purposes only.

You should read the product packaging and instructions carefully and seek advice from a pharmacist, doctor or other qualified healthcare professional where appropriate.

You should not rely solely on information provided on our website when making decisions about your health or treatment.


5. Prescription, Pharmacy-Only and Restricted Products

Certain medicines, pharmacy products and healthcare products may be subject to Australian laws, regulations, professional requirements or restrictions on their sale or supply.

Where a product requires a prescription, pharmacist assessment, identification, consultation or other legal or professional requirement, we may require additional information before the product can be supplied.

We reserve the right to refuse or cancel an order where:

  • the legal requirements for supply have not been met;

  • a valid prescription or other required authority cannot be provided or verified;

  • a pharmacist determines that the product is not appropriate to supply;

  • the requested quantity is not permitted;

  • the product is subject to a supply restriction; or

  • we reasonably believe the order has been placed fraudulently or for an inappropriate purpose.

Where an order cannot be supplied for these reasons, we will contact you and, where appropriate, arrange a refund for amounts paid for products that cannot be supplied.


6. Placing an Order

When you place an order through our website, you are making an offer to purchase the selected products.

After placing an order, you will generally receive an order confirmation email.

An order confirmation does not necessarily mean that your order has been accepted or that all products are available.

We reserve the right to accept or decline an order where reasonably necessary, including where:

  • a product is unavailable;

  • there is an error in the product or pricing information;

  • there is a supply restriction;

  • we are unable to verify information provided;

  • the order appears fraudulent or suspicious; or

  • we are unable to fulfil the order for another legitimate reason.

If we cancel an order after payment has been made, we will arrange a refund for any amount paid for products that we cannot supply.

However, stock levels can change quickly and an item shown as available may become unavailable before your order is processed.

If a product becomes unavailable after you place an order, we may contact you to discuss available options, including a suitable alternative where appropriate, or provide a refund for the unavailable product.

We will not substitute a product without your consent where your consent is required.


8. Pricing

All prices displayed on our website are in Australian dollars (AUD) and include GST where applicable.

We make reasonable efforts to ensure that prices are accurate. Occasionally, an obvious pricing or product information error may occur.

If we identify an error affecting your order, we may contact you before processing the order to confirm whether you wish to proceed at the correct price.

If you do not wish to proceed, we will cancel the affected order and refund any amount you have paid for that product.

Payment must be made using one of the payment methods available at checkout.

By providing payment information, you confirm that you are authorised to use the selected payment method.

We may use third-party payment providers to process payments. Your payment information may be handled by those providers in accordance with their applicable terms and privacy policies.

We do not knowingly store complete payment card details on our own systems where payment processing is handled by a third-party payment provider.


10. Delivery

We will deliver orders to the address provided during checkout, subject to the delivery options available for your location.

Delivery times provided on our website are estimates only and may be affected by:

  • courier or postal delays;

  • public holidays;

  • weather or other events outside our reasonable control;

  • incorrect or incomplete delivery information;

  • product availability; or

  • legal or regulatory requirements.

We are not responsible for delays caused by events outside our reasonable control.

You are responsible for providing accurate delivery information.


11. Click & Collect

Where Click & Collect is available, orders will be available for collection from our pharmacy once you have received confirmation that your order is ready.

You may be required to provide appropriate identification or order information when collecting your order.

Certain products may have additional collection requirements due to legal, pharmacy or safety requirements.


12. Cancellations

If you wish to cancel an order, please contact us as soon as possible.

We will make reasonable efforts to accommodate cancellation requests before an order has been processed or dispatched.

Once an order has been processed, dispatched or supplied, cancellation may not be possible.

Nothing in this section limits your rights under the Australian Consumer Law.


13. Returns and Change of Mind

We do not generally offer refunds or exchanges where you have simply changed your mind, selected the wrong product, ordered the wrong size or colour, or no longer require the product.

However, this does not affect your rights under the Australian Consumer Law.

For health, safety and quality-control reasons, we may be unable to accept the return or resale of certain medicines, prescription products, refrigerated products, opened products or other pharmacy-related products once they have left our premises.

This does not affect any rights you may have where a product does not meet the consumer guarantees under Australian law.

14. Faulty, Damaged or Incorrect Products

If you receive a product that is:

  • faulty or defective;

  • damaged;

  • significantly different from its description;

  • not fit for the purpose for which it was sold; or

  • otherwise does not meet the consumer guarantees applicable under Australian law,

please contact us as soon as possible.

Depending on the circumstances, you may be entitled to a repair, replacement, refund or another remedy under the Australian Consumer Law.

Where we have supplied an incorrect product, please contact us so that we can assess the issue and arrange an appropriate resolution.

We may request reasonable proof of purchase, such as an order confirmation, receipt or tax invoice.


15. Refunds

Where a refund is approved, we will generally refund the amount using the original payment method where reasonably practicable.

The time taken for a refund to appear in your account may depend on your bank or payment provider.

Nothing in these Terms limits any refund or other remedy required under the Australian Consumer Law.


16. Promotions and Discount Codes

From time to time, we may offer promotional prices, discount codes, special offers or other promotions.

Promotional offers may be subject to additional terms, including:

  • expiry dates;

  • minimum purchase requirements;

  • product exclusions;

  • quantity limits;

  • one-use-per-customer restrictions; or

  • other conditions stated at the time of the promotion.

Promotions cannot be combined unless expressly stated.

We reserve the right to correct obvious errors or withdraw a promotion where reasonably necessary, subject to applicable law.


17. Gift Cards and Vouchers

Where gift cards or vouchers are offered through our website, they may be subject to specific terms provided at the time of purchase.

Gift cards and vouchers cannot be exchanged for cash except where required by law.

Gift card expiry and redemption conditions will be disclosed in accordance with applicable Australian law.
